Withdrawal

A User requesting a service for purposes unrelated to their professional activity has the right to withdraw from the purchase contract concluded with PierBacco.com or the Partner without penalty and without having to provide any reason, within 14 business days pursuant to and for the purposes of Article 52, paragraph 1 of the Consumer Code, starting from the day of receipt of the product purchased on PierBacco.com. The Customer may exercise the right of withdrawal, pursuant to Article 54, paragraph 1 of the Consumer Code, Part B of the Consumer Code, by submitting an explicit declaration of their decision to withdraw from the contract, to be sent either by registered letter with return receipt to F.lli Talamonti srls, Via T. Edison, 20a, 00015 Monterotondo (RM), or by email to info@pierbacco.com.

The registered letter with return receipt or email must include the product name and order number. The burden of proof regarding the correct exercise of the right of withdrawal, in accordance with the procedure indicated above, lies with the User.

Following the correct exercise of the right of withdrawal, the User will be responsible for returning the goods at their own expense and in their own manner, without undue delay and in any case within 14 days from the date on which the User communicated to PierBacco.com their decision to withdraw from the contract pursuant to Article 54, paragraph 4. The User must clearly affix to the packaging the document received from PierBacco.com following the aforementioned withdrawal notice. This document will already indicate the shipping address and order details necessary to identify the return at its destination. Users are advised to include a copy of this document inside the packaging to avoid loss or the inability to identify the return once it reaches the warehouse. The User will be responsible for shipping costs unless PierBacco.com has informed the User of this upon conclusion of the contract, in accordance with Article 57, paragraph 1 of the Consumer Code.

The goods must be stored, handled, and inspected with reasonable diligence and returned intact, complete in all their parts, with all accessories and instruction leaflets, identification tags, and original labels, if any, still attached to the goods, intact and untampered with, perfectly suitable for their intended use, and free from signs of wear or dirt.
As provided for by Article 57, paragraph 2 of the Consumer Code, the User is responsible for any decrease in value resulting from handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods. In such cases, PierBacco.com, upon written notification to the User within 5 business days of receiving the goods, may reduce the refund amount based on such decrease in value. PierBacco.com may, if the refund has already been paid, provide the User with the bank details for payment of the amount due by the User due to the decrease in value of the goods.
PierBacco.com may refuse to accept a return for food products that have been consumed even partially. Pursuant to Article 59 of the aforementioned Consumer Code, return is excluded for goods made to measure or personalized, or which, by their nature, cannot be returned, or are subject to rapid alteration or deterioration.

Exceptions to the Right of Withdrawal

In any case, it is understood that, with reference to services, the right of withdrawal cannot be exercised by the User after the complete supply of the products by PierBacco.com, if the supply itself began with the User's express consent and the User has agreed to lose the right of withdrawal following full performance of the service by PierBacco.com.
In any case, pursuant to Article 59 of the Consumer Code, goods made to measure or personalized, or which, by their nature, cannot be returned or are subject to rapid alteration or deterioration, are excluded from the right of withdrawal.

Refunds

Any refunds due by PierBacco.com will be made pursuant to Article 56, paragraph 1, of the Consumer Code, as quickly as possible, and in any case no later than 14 days from the date on which the event giving rise to the refund occurred. In the case of withdrawal, the refund will be made from the day on which the goods being returned are returned, upon prior notification, to F.lli Talamonti srls, Via T. Edison, 20a, 00015 Monterotondo (RM). PierBacco.com will process the refund using the same payment method used by the User for the initial transaction, unless expressly agreed otherwise with the User and provided that the User does not incur any costs as a result of using the different payment method. If the User has expressly chosen a different type of delivery that involves higher delivery costs than those associated with the standard delivery offered by PierBacco.com ("Additional Costs"), PierBacco.com will not be required to reimburse the related Additional Costs. It is understood that, except in cases where PierBacco.com has decided to collect the goods directly, PierBacco.com may withhold the refund until it has received the goods.
