Premises and acceptance of the General Conditions of Sale

These general terms and conditions (hereinafter also "General Terms and Conditions") govern the offer of products by F.lli Talamonti srls (hereinafter also "PierBacco.com") on www.PierBacco.com (hereinafter also "Site"). The User must accept the General Terms and Conditions when registering on the Site in order to take advantage of the offers formulated therein and proceed with the purchase of products.

PierBacco.com reserves the right to modify the General Conditions, in whole or in part, at any time, by notifying Users via the Site at least 30 days in advance, should the terms and conditions for using the products and services offered change. Users are therefore advised to periodically consult this page to stay informed of the applicable conditions. It is understood that use of the Site after such changes constitutes tacit acceptance of the changes.

Ownership of the Site - Type of Offers

The Site is owned by F.LLI Talamonti srls, with registered office in Monterotondo, Italy, 00015, Via Tommaso Edison, 20/a, Tax Code and VAT number 14598101005, Company Register RM 1532483. The name "PierBacco.com" is a domain used exclusively by F.lli Talamonti Srls. The products on the Site are resold directly by PierBacco.com, including through drop-shipping (hereinafter also "Direct Sales"). Unless otherwise specified on the product detail page, the products are sold directly by PierBacco.com.

Products can be sold both through a permanent catalog and through "flash deals," which are promotions subject to quantity and/or time limits. The product offering covers the food, alcohol, and accessories categories (wines, sparkling wines, beers, rum, grappa, other spirits and distilled beverages, coffee, packaged products such as sauces, honey, canned meats, and other food products and accessories for preparing, consuming, or preserving food).

Registration on the Site

The Site is intended exclusively for Users who are 18 years of age or older. Browsing and using the services offered on the Site are accessible after registration.

Registration is free. Users who register on the Site must provide certain personal information and follow all the steps in the procedure (hereinafter also "Complete Registration"). Upon Complete Registration, the User will be asked to choose a Password, which the User undertakes not to disclose, even temporarily, to third parties and to maintain with due care, diligence, and confidentiality under his/her own responsibility. These credentials constitute the sole means of identifying the User and validating their access to the offers. The User is therefore informed that all actions performed using these credentials will be attributed to him/her and will be binding on him/her.

The User is required to immediately inform PierBacco.com of any unauthorized or improper use of their login credentials or to report any violations by third parties. If PierBacco.com discovers any violations, it may, at its sole discretion, deny access, permanently delete the information contained therein, or refuse to open new Accounts by the same User.

At any time, the User may update and/or modify, or request deletion of the information provided during Registration. However, if a deletion request is made, PierBacco.com may temporarily retain such information, in whole or in part, solely for the purpose of processing any purchases made and/or completing accounting and tax procedures.

Complete Registration is required to proceed with the purchase of products and to access summary information relating to the activities carried out by the User on the site (also "Account").

Offer conditions

PierBacco.com offers the purchase of goods at the prices indicated on the Site. PierBacco.com reserves the right not to process orders from individuals other than "consumers," in accordance with its commercial policy. In any case, PierBacco.com does not sell alcoholic beverages to individuals under the age of 18. By placing an order, the consumer warrants that the person placing the order and, if different, the recipient of the goods are both over the age of 18.

Prices are expressed in euros and include VAT. Shipping costs may be fixed or variable, calculated based on weight, the number of items selected, and/or the destination address. Shipping costs may also be included in the sale price of some items or be free if the total order amount exceeds a certain value or as a result of a specific promotion. The User is always informed of the shipping costs before completing the purchase process and making payment. We reserve the
right to apply shipping costs even when the minimum "free shipping" threshold is reached if the volume, weight, or destination is an extraordinary item for our standards.

The images accompanying the product information sheets or offers may not be fully representative of their features but may differ in color, size, and accessory products shown. All information supporting purchases is intended as general information only and therefore does not reflect the actual features of a single offer.

Offers may be subject to quantity or time limitations, after which they may no longer be available. The validity date and/or available quantity of offers are displayed on the Site so that the User can review them. PierBacco.com may modify the duration or quantity of an offer at any time and at its sole discretion, but will only process orders placed during the validity of a given offer. An offer may be published multiple times. In some cases, an item may become unavailable after purchase; in such cases, PierBacco.com will refund the User, if applicable. It is also possible that for some product offers, a specific variant is not guaranteed, and the User will be asked to specify one or more preferences at the time of purchase. In such circumstances, the User understands that they may receive a product variant different from the one selected at checkout.

In the case of promotional sales or through flash-deal formulas as specified above, the full price indicated in the offer ("Crossed Out Price") and in relation to which the discount that PierBacco.com applies is calculated may correspond to:

(i) at the retail list price indicated by the supplier;

(ii) the results of market surveys.

The calculation methods for the Crossed Out Price vary from product to product.

Purchase procedure and payment methods

Having read the conditions of the offer, the User can complete the purchase by following the procedure on the Site.

Before finalizing your purchase, you will be shown a summary showing the unit cost of the selected item and the total if purchasing multiple quantities of the same or different items. Shipping, delivery, or postal charges may be fixed or variable, calculated based on the weight of the goods, the number of items selected, and/or the shipping address specified by the User during the purchase process. Shipping charges may also be included in the sale price of some items or may be free if the total order amount exceeds a certain amount or as a result of a specific promotion. The User is always informed of the shipping costs before completing the purchase process and making payment. Once the purchase is complete, the User must proceed with payment, which will be made to PierBacco.com.

Following successful payment, the User will receive a confirmation email containing information regarding the purchased offer. The email will also contain a reference to these General Terms and Conditions. The confirmation will contain a summary of the delivery and billing addresses. The goods will be shipped within the timeframe indicated in the order confirmation. Delivery times are also indicated before completing the purchase process in the cart summary or on the product page. This information is indicative and does not represent a specific date, as it is not always possible to predict possible delays due to the courier responsible for delivery to the Customer or other causes due to third parties or force majeure not attributable to PierBacco.com. In the case of temporary offers (flash deals), the goods may be shipped to the User after the expiration of the offer. In the absence of a confirmation email, the purchase cannot be considered validly concluded. In this case, if the amount of the failed purchase is erroneously charged to the User, the User will be required to promptly notify PierBacco.com by sending an email to info@pierbacco.com, in order to allow PierBacco.com to verify the incident and, if necessary, proceed with the refund of the amount paid.

Accepted payment methods, unless otherwise specified or agreed with the User, are: credit cards and prepaid cards from Visa, Mastercard, Maestro, Postepay, and American Express, PayPal accounts, Apple Pay or Google Pay accounts, and bank transfer. PierBacco.com may, by agreement between the parties, in some or all cases and at its sole discretion, offer the alternative payment method of cash on delivery (cash upon delivery).

Payment by bank transfer must be made within the terms indicated and in any case no later than 3 days from order confirmation. After this time, it may not be possible to guarantee shipment of the goods. In this case, PierBacco.com™ will cancel the order and, if necessary, credit the sender, at no additional cost and via bank transfer, for any payment received after the deadline.
It is mandatory to indicate the exact amount received at the time of order confirmation, without rounding up or down, under penalty of cancellation of the order.
Shipments for products paid for by bank transfer will only take place once the amount has actually been credited to our account. 

Unless otherwise specified in the offer terms, the amount due will be charged upon confirmation of payment.

If the User realizes that they have provided incorrect and/or incomplete personal information or a shipping address, they must notify us promptly and within the order processing deadlines by sending an email to info@pierbacco.com. In all cases, the User is solely responsible for any incorrect and/or incomplete personal information or shipping address, which may result in the loss of the sum paid if the goods are delivered to unauthorized persons.

The request for an immediate invoice or accompanying invoice must be made during the purchase process or immediately afterward by contacting our customer service at info@pierbacco.com to ensure all necessary information is provided. Unless specifically requested, we will issue a generic, non-personalized tax document, and it will not be possible to request a new tax document at a later date.

Security in transactions

PierBacco.com is very careful about the security of its users. PierBacco.com does not process or store payment information (e.g., credit card numbers), which is processed and/or stored by the relevant payment service providers. The actual payment is processed through secure and encrypted payment information fields, served directly by the Shopify Payments payment service. Only after the transaction has been completed does the banking service provider notify PierBacco.com of the payment outcome, without providing any sensitive information. For this reason, PierBacco.com has no control over the possible refusal of the credit card used for payment. PierBacco.com cannot therefore be held liable in any way for any direct or indirect consequences arising from the use of the credit card by the user to pay for purchased products and/or services.

Browsing PierBacco.com is protected and encrypted with a "128/256-bit Extended Validation SSL" security certificate, issued by Symantec/DigiCert following a precise and constant verification process of the authenticity of the company's personal information and domain ownership. You can also verify the authenticity of the certificate and its ownership by clicking on the appropriate security section of your browser, usually next to the address bar, on the page title, or in the status bar.

Coupon

PierBacco.com may issue discount codes (hereinafter "Coupons") that the User can use when purchasing products. Coupons are issued in the form of an alphanumeric code, and their value (in euros) is determined by PierBacco.com at its sole discretion. The Coupon can be entered by the User in the "Coupon" field when placing the order. The Coupon entered in this way will be automatically deducted from the total order amount, excluding any shipping costs, before payment. Percentage discount coupons are not applied to products already on sale. Coupons are generally valid for a limited time, after which they can no longer be used. Coupons may be subject to a minimum spend, below which they cannot be used. Unless otherwise specified, the Coupon is personal and tied to the User's Account and may be used for a single purchase, after which it will automatically be invalidated. Coupons cannot be combined. Coupons may not be sold, assigned, and/or transferred to third parties without the express authorization of PierBacco.com. PierBacco.com reserves the right to cancel any previously issued Coupon, even before its expiration, without having to justify the reason and without the right to compensation or damages. PierBacco.com may also issue Coupons to Users who invite acquaintances, friends, and family members to view the Site's offers and register on it. To complete this procedure, the Site provides certain features such as "Recommend to a friend," "Email an offer," "Share on Facebook," "Twitter," other social networks, etc. For each new invitee who purchases an offer within a certain time period, PierBacco.com may award the User a Coupon, with a value determined from time to time at PierBacco.com's discretion, to be used on their Account for a subsequent purchase. PierBacco.com reserves the right to cancel Coupons issued to users who misuse them, without notice and without the right to compensation or damages.

Shipping and delivery

PierBacco.com and its partners accept orders for delivery exclusively within Italy, including the islands, with the exception of San Marino, the Vatican City, Livigno, and Campione d'Italia. Goods will be shipped within the maximum timeframe indicated in the offer terms and conditions and, for temporary offers (flash deals), may begin upon the expiration of the offer. Goods will be shipped within the timeframe indicated in the order confirmation. Delivery times may also be indicated before completing the purchase process in the cart summary or on the product page. This information is indicative and does not represent a specific date, as it is not always possible to predict possible delays due to the courier responsible for delivery to the customer. In any case, PierBacco.com, unless otherwise specified on the product page, undertakes to deliver the goods within 10 working days from the order date. Deliveries generally occur within 24–48 working hours throughout Italy, with the exception of the islands, where the average delivery time is 48–72 working hours. In the unlikely event that the goods become unavailable for any reason after receiving the order, a refund of any payment received will be issued, free of charge to the User. The User will be notified by email when the product is shipped by PierBacco.com.

The User will be notified, if available, of the courier's name and the shipment's tracking number (waybill or "Tracking"), through which they can track their shipment. This information, if available, will also be visible within the User Account.

PierBacco.com cannot guarantee that multiple products purchased at the same time will be delivered in a single shipment, nor that multiple shipments will arrive at their destination at the same time. A specific delivery date or time cannot be guaranteed, as this depends on the courier, the destination address, and the delivery person. PierBacco.com cannot therefore be held responsible for any direct or indirect consequences arising from these timeframes. Unless otherwise specified during the purchase process, delivery of the ordered items is intended to be at street level.

When shipping bottles, PierBacco.com uses patented and courier-approved packaging, designed to ensure product integrity. In any case, upon delivery of the goods by the courier, the User is required to verify that the packaging is intact, undamaged, or otherwise altered, including the sealing materials (adhesive tape or strapping), and that no liquid has leaked. Any damage to the packaging and/or product must be immediately reported by the User, including a written reservation (and specifying the reason for the reservation, e.g., "Punched packaging," "Crushed packaging," etc.) on the courier's delivery note. Once this document is signed, the User may no longer raise any disputes regarding the characteristics of the delivered goods. Any issues regarding the physical integrity, correspondence, or completeness of the products received must be reported within 3 days of delivery by sending an email to: info@pierbacco.com

If the goods are not delivered within the specified timeframe, the User must notify PierBacco.com, which will verify the shipment status and identify any discrepancies directly with the courier. In the event of a shipping issue (for example, a package lost or destroyed during transport), PierBacco.com will, in the case of Direct Sales, either resend the product, subject to stock availability, at no additional cost or expense to the User, or issue a full refund.

Product conformity guarantee

PierBacco.com works diligently and in absolute good faith in selecting suppliers and Partners, verifying their suitability to supply the products in the quantities and according to the characteristics described in the purchase offers. PierBacco.com cannot be held liable for personal injury resulting from any violation by manufacturers. In any case, PierBacco.com cannot guarantee the completeness of the information provided by the Supplier, nor that the description in the product sheet or offer corresponds exactly to the product actually delivered, nor the legitimacy of the Supplier's use of images, videos, and distinctive signs. The User also acknowledges that the images used in the offers may sometimes be merely indicative of the product and may not always accurately represent the delivered product. PierBacco.com will be directly responsible for the conformity of the products under warranty. In the event of non-compliant products, the User will contact PierBacco.com by sending an email to: info@pierbacco.com. PierBacco.com will provide a suitable repair center to inspect and repair the goods under warranty or, once the defect has been verified, will proceed with the subsequent repair or replacement, or will issue a refund by crediting the original payment method or issuing a coupon equal to the value of the purchased product. In any case, the legal guarantee is reserved for consumers, or individuals who have made a purchase on PierBacco.com for purposes other than any business, commercial, artisanal, or professional activity they may engage in.

Withdrawal

Users requesting services for purposes other than their professional activity have the right to withdraw from the purchase contract concluded with PierBacco.com or the Partner without penalty and without having to provide any reason, within 14 working days pursuant to and for the purposes of art. 52, paragraph 1 of the Consumer Code, starting from the day of receipt of the product purchased on PierBacco.com. The right of withdrawal may be exercised by the Customer, pursuant to art. 54, paragraph 1 of the Consumer Code, Part B of the Consumer Code, by submitting an explicit declaration of their decision to withdraw from the contract, to be sent either by registered letter with return receipt to F.lli Talamonti srls, Via T. Edison, 20a, 00015 Monterotondo (RM) or by email to pierbaccoweb@gmail.com.

The registered letter or email must include the product and order number. The burden of proof regarding the correct exercise of the right of withdrawal, in accordance with the procedure indicated above, lies with the User.

Following the correct exercise of the right of withdrawal, the User will be responsible for returning the goods without undue delay and in any case within 14 days from the date on which the User communicated to PierBacco.com his or her decision to withdraw from the contract pursuant to Article 54, paragraph 4. The User must visibly affix to the packaging the document received from PierBacco.com following the aforementioned notice of withdrawal, which already indicates the shipping address and order details necessary to identify the return at its destination. The User is advised to include a copy of this document inside the packaging as well, in order to avoid loss or the inability to identify the return once it reaches the warehouse. The User will be responsible for the related shipping costs of the goods, unless PierBacco.com has notified the User of this upon conclusion of the contract, in accordance with Article 57, paragraph 1 of the Consumer Code.

The goods must in any case be stored, handled and inspected with normal diligence and returned intact, complete in all their parts, accompanied by all accessories and information sheets, identification tags and original labels, where present, still attached to the goods and intact and not tampered with, as well as perfectly suitable for the use for which they are intended and free from signs of wear or dirt.

As provided for by Article 57, paragraph 2 of the Consumer Code, the User is responsible for any decrease in value resulting from handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods. In such case, PierBacco.com, upon written notification to the User within 5 business days of receiving the goods, may reduce the refund amount based on such decrease in value. If the refund has already been paid, PierBacco.com will provide the User with the bank details for payment of the amount owed by the User due to the decrease in value of the goods.

PierBacco.com may refuse to accept returns for food products that have been consumed even partially. Pursuant to Article 59 of the aforementioned Consumer Code, returns are excluded from the option of returns for custom-made or personalized goods, or goods that, by their nature, cannot be returned, or are subject to rapid alteration or deterioration.

Exceptions to the right of withdrawal

In any case, it is understood that, with reference to the provision of services, the right of withdrawal cannot be exercised by the User after the complete supply of the products by PierBacco.com if the supply itself began with the express agreement of the User and the latter has agreed to lose the right of withdrawal following the full performance of the service by PierBacco.com.

In any case, pursuant to art. 59 of the Consumer Code, goods made to measure or personalized, or which, by their nature, cannot be returned or are subject to rapid alteration or deterioration, are excluded from the right of withdrawal.

Refunds

Any refunds by PierBacco.com, if due, will be made pursuant to Article 56, paragraph 1 of the Consumer Code, as soon as possible, and in any case no later than 14 days from the date on which the event giving rise to the refund occurred and, in the case of withdrawal, from the day on which the goods subject to cancellation are returned, upon notification, to F.lli Talamonti srls, Via T. Edison, 20a, 00015 Monterotondo (RM). PierBacco.com will process the refund using the same payment method used by the User for the initial transaction, unless expressly agreed otherwise with the User and provided that the User does not incur any costs as a result of using the different payment method. If the User has expressly chosen a different delivery method that involves higher delivery costs than those associated with the standard delivery offered by PierBacco.com ("Additional Costs"), PierBacco.com will not be required to reimburse the related Additional Costs. It is understood that, except in cases where PierBacco.com has decided to collect the goods directly, PierBacco.com may withhold the refund until the goods have been received.

PierBacco.com Responsibility

PierBacco.com will not be liable for any damages that may arise from the use of the Site, such as computer viruses, omissions, service interruptions, and software failures, including damage to the User's computer equipment, which prevent or delay the provision of services if these are due to external causes, force majeure, and/or third parties beyond the control of the owner.

In any case, PierBacco.com cannot under any circumstances be held responsible for delays, defects, or discrepancies resulting from events beyond its reasonable control, such as, but not limited to: (i) force majeure events; (ii) events resulting from third-party actions, such as the interruption or malfunction of telecommunications operator services and/or power lines, or acts or omissions by carriers or shipping agents.

PierBacco.com will not be responsible for direct or indirect damages resulting from the sale and excessive or reckless consumption of alcoholic and similar products.

Industrial and intellectual property

Without prejudice to the limitation on the use of Suppliers' distinctive signs, PierBacco.com owns all rights to the Site's graphic and conceptual content, as well as any distinctive signs displayed therein. Reproduction, even partial, of the Site's content and graphics, as well as any distinctive signs displayed therein, is therefore prohibited. PierBacco.com also owns the technological platform that manages the Site.

Privacy

For the purposes of EU Regulation no. 2016/679 on the protection of natural persons with regard to the processing of personal data, Mr./Ms. is informed that the personal data provided and acquired by him/her will be processed in compliance with the provisions of the aforementioned Regulation, in compliance with the resulting rights and obligations.

The privacy policy is to be considered an integral and essential part of these General Conditions and is accessible in the Privacy section of the Site.
4. d) Rights of the interested party in relation to the data subject to the processing referred to in this information notice. The interested party is recognized at any time the right to:

Through this website, F.lli Talamonti Srls collects anonymous data and information (browser type, geographic location, date and time), which it processes to optimize the website management and optimization, as well as for statistical purposes and to gather more information about its services and bookings. This information may reside on servers located in Italy, but will never be shared by the owner or its managers with third parties or used to contact website visitors unless they request or consent.

Providing consent to the processing of personal data is optional. If you refuse to provide consent, we will not be able to provide the services indicated above.

PierBacco.com has no control over these sites and assumes no responsibility for the accuracy, nature, quality, or completeness of the information contained on third-party sites. The content of these sites does not represent PierBacco.com products, services, or information.

Conciliation Procedure. Applicable Law and Jurisdiction.

These General Conditions will be governed in all respects by Italian law.

For any dispute concerning the interpretation, execution, and/or termination of the contract between the User and PierBacco.com, the Parties acknowledge that the Court of the User's place of residence or domicile shall have jurisdiction if the User is considered a "consumer" under applicable law. If the User is a professional, the Court of Tivoli shall have jurisdiction.

Severability Clause

. If a competent court finds any provision of these Terms and Conditions invalid or unenforceable for any reason, that provision shall be deemed null and void, but shall not affect the application and/or interpretation of these Terms and Conditions. The remaining provisions of these Terms and Conditions shall remain in full force and effect, as if the invalid or unenforceable provision were not part of these Terms and Conditions.
